2. Acceptance

By using apoagency.io or hiring APO Agency you accept these terms. If you do not agree, do not use the site or hire the service.

3. Services and scope

APO Agency provides digital marketing services: web design and landing pages, Meta and Google Ads campaigns, branding, and social content (launch videos and carousels). The exact scope of each job (deliverables, deadlines and price) is set out in a written proposal. Anything not in the proposal is not included and is quoted separately.

4. Proposals and prices

• Proposals have a fixed price and the validity stated in the document. Prices are in US dollars (USD) and, unless stated otherwise, exclude taxes.
• The proposal is yours even if you do not hire us, but it cannot be used by third parties to copy our way of working.
• Extra work or changes in scope are agreed in writing before they are carried out.

5. Payment

• Web design and landing pages: 50% upfront to start and 50% on delivery, before the site goes live.
• Online stores: 70% upfront and 30% on delivery.
• Monthly services (campaigns, content, maintenance): paid monthly in advance.
• The upfront payment is non-refundable once work has started, except as set out in the cancellations section.
• Late payment may pause the work and the deadlines.

6. Revisions

Each proposal states the revision rounds included (two by default). A round is a set of changes sent in a single message. Additional rounds, or changes that alter the scope, are quoted separately.

7. Client obligations

You must deliver the required material on time (copy, logos, photos, access and approvals) and name a person who can decide. Delivery deadlines count from the moment we receive the upfront payment and the complete material. You are responsible for making sure the material you provide is yours or that you have permission to use it.

8. Domain and hosting

The domain and hosting are bought in the client’s name and at the client’s expense. We can help you set them up, but renewal costs are yours. We are not responsible if a third-party service fails or expires.

9. Paid advertising

Ad spend (Meta, Google or other platforms) is paid directly to the platform, with your own account and payment method. Our fees do not include ad spend. Platforms may reject ads, suspend accounts or change their rules and algorithms. For that reason we do not guarantee specific results (number of leads, sales, costs or return on investment). The results we show from other clients are examples, not a promise for your case.

10. Intellectual property

Once you pay the full amount of the job, we transfer to you the rights over the final deliverables made for you (for example, the site design, the logo or the content pieces). Until then, the rights belong to APO Agency. We reserve the right to show the work in our portfolio unless we agree otherwise in writing. APO Agency’s own tools, templates and methods, and licensed third-party components, remain subject to their own licenses.

11. Cancellations

You may cancel a job at any time by notifying us in writing. You will pay for the work done up to the cancellation date, calculated proportionally. Monthly services are cancelled with 15 days’ notice. If APO Agency cancels for reasons not attributable to the client, it will refund the part paid for work not carried out.

12. Use of the website

You agree to use the site lawfully. It is forbidden to use it for fraudulent purposes, to try to access systems or data without authorization, to transmit harmful code or to collect third-party data without consent. The texts, graphics, logos and images on the site belong to APO Agency or its authors and may not be reproduced without written permission.

13. Personal data

We process your data in line with our Privacy policy and Ecuador’s Organic Law on Personal Data Protection (LOPDP).

14. Limitation of liability

APO Agency answers for its work with the diligence of a professional. To the fullest extent permitted by law, our total liability to you for any claim related to a service is limited to the amount paid for that service. We are not liable for lost profit, data loss or indirect damages, or for interruptions of third-party services (ad platforms, hosting, social networks, WhatsApp).

15. Changes to these terms

We may change these terms. Changes apply from the moment they are published on this page. Jobs already hired are governed by the terms in force when the proposal was accepted.

16. Governing law and jurisdiction

These terms are governed by the laws of the Republic of Ecuador. Any dispute will be submitted to the competent courts of Ecuador, without prejudice to the parties agreeing on mediation or arbitration.
